Independent PEO Comparisons for Delaware Employers

Thousands of companies are incorporated in Delaware, but Delaware employment rules follow the people who actually work here. If your team sits in Wilmington, Dover, or the beach towns, you now manage a paid leave program that started paying benefits in 2026, a state retirement mandate, and an unemployment wage base that rises again in 2027. That is a lot for a small HR team to absorb at once.

AlignPEO helps Delaware businesses compare PEO providers that can carry that load. We are an independent broker, so we have no house plan to push. We review your headcount, leave obligations, and benefits, then put options from our 15+ partners side by side, free of charge.

Why Delaware Businesses Use a PEO

Delaware's payroll got busier in 2026: a new paid leave program, a higher unemployment wage base, a state retirement mandate, and Wilmington's city wage tax. A PEO handles each one.

Paid Leave Tiers by Headcount

Delaware Paid Leave began paying benefits in 2026. Employers with 10 to 24 employees fund parental leave at 0.32% of wages, and employers with 25 or more owe the full 0.8%. A PEO tracks which tier you are in.

Wilmington's 1.25% Wage Tax

Wilmington taxes the wages of its residents and of anyone who works inside city limits. A PEO sets up the city withholding so no one is missed.

Retirement Plan at Five Employees

Delaware EARNS requires employers with five or more employees and no retirement plan to register and offer the state program. A PEO 401(k) meets the requirement.

Pay Ranges Coming in 2027

Starting September 26, 2027, employers with 26 or more employees must post pay ranges and a benefits description. A PEO helps you build ranges ahead of the deadline.

What Else Do PEO Services Cover?

At AlignPEO, we connect small to medium-sized businesses with PEO services that cover every aspect of human capital management.

Payroll and Tax Administration

Delaware withholds a graduated income tax that reaches its top rate of 6.6% at $60,000 of taxable income. Unemployment tax applies to the first $14,500 of each employee's wages in 2026, rising to $16,500 in 2027, and new employers start at 1.0%. Wilmington adds its 1.25% wage tax. Our PEO partners handle state, city, and paid leave filings together.

Employee Benefits and Health Plans

Delaware Paid Leave offers up to 12 weeks of paid parental leave a year. At employers with 25 or more employees, it also covers up to six weeks of medical or caregiving leave every two years. Employers can deduct up to half of the contribution from wages or apply to use a private plan. A PEO coordinates the program with your PTO, and its group plans add medical, dental, vision, life, and 401(k) coverage.

HR Compliance and Risk Management

Delaware's minimum wage has been $15.00 per hour since January 1, 2025, with no automatic increases and no local rates. Employees who work 7.5 consecutive hours or more must get a 30-minute meal break, and employers may not ask applicants about salary history. Our PEO partners keep postings, handbooks, and manager training aligned with state law.

Recruitment and Onboarding Support

Delaware's pay transparency law takes effect September 26, 2027, for employers with 26 or more employees. Building pay ranges now avoids a scramble later. PEO partners help you set ranges and run applicant tracking, background checks, I-9 verification, and onboarding.

Workers' Compensation and Safety Programs

Delaware requires workers' comp once you have a single employee, with farm labor as the main exception. PEOs bring the policy, safety training, and claims handling together, which helps small employers in construction, food processing, and hospitality.

Delaware Packs Several Economies Into a Small State

Wilmington and northern New Castle County are home to banking, credit card operations, corporate law firms, and the chemical companies that grew up around DuPont. Newark centers on the University of Delaware. Dover combines state government with Dover Air Force Base, and Sussex County runs on beach tourism and poultry processing.

A bank operations center in Wilmington and a seasonal restaurant group in Rehoboth Beach face different paid leave rules and need very different benefits.

Our job is to find the PEO that handles your version of Delaware best, starting with your headcount, locations, and seasonal swings.
