PEO Options for Tennessee Employers, Compared Side by Side

Tennessee is one of the simplest states for payroll tax, with no state income tax on wages. That simplicity tempts many owners to skip a PEO. The ones who use one usually do it for benefits, workers' comp, and the HR support a growing team needs, not for tax filing.
AlignPEO helps Tennessee businesses decide whether a PEO makes sense, and which one. As an independent broker, we are not a PEO and do not push a single product. We compare providers from our 15+ partner network for companies in Nashville, Memphis, Knoxville, Chattanooga, and statewide, and we do it at no charge to you.
Why Tennessee Businesses Use a PEO
With no state income tax and no state minimum wage, Tennessee keeps payroll light. The value of a PEO here comes from benefits, workers' comp, and E-Verify.

E-Verify at 35 Employees
Private employers with 35 or more employees must use E-Verify for new hires, with fines that escalate for repeat violations. A PEO runs every case within three business days.

Workers' Comp at Five Employees
Most Tennessee employers need workers' comp at five employees, but construction and coal mining employers need it from the first. A PEO can cover you before you hit either threshold.

Healthcare and Music Industry Talent
Nashville's healthcare companies and entertainment industry set high expectations for benefits. PEO group plans help smaller firms compete for the same people.

Logistics Hubs and Hourly Teams
Memphis is a national freight hub, and distribution work runs on large hourly teams with high turnover. A PEO absorbs the onboarding and payroll volume.
What Else Do PEO Services Cover?
At AlignPEO, we connect small to medium-sized businesses with PEO services that cover every aspect of human capital management.
Payroll and Tax Administration
Tennessee does not tax wages, so there is no state withholding. The one state payroll tax is unemployment insurance, charged on the first $7,000 of each employee's wages at 2.7% for new employers. Tennessee sets unemployment rates on a July-to-June cycle rather than the calendar year, so rate changes land mid-year. Our PEO partners handle federal taxes, unemployment, and every year-end form.
Employee Benefits and Health Plans
Tennessee has no state paid sick leave or paid family leave law, and recent legislative sessions have rejected proposals to add them. Benefits are entirely your call, which makes them your best recruiting lever. PEO group plans offer medical, dental, vision, life, and retirement coverage at large-group pricing.
HR Compliance and Risk Management
Tennessee has no state minimum wage, so the federal $7.25 applies, and state law blocks cities and counties from setting their own. Tennessee does run its own OSHA-approved state plan and requires a rest or meal break for employees scheduled six hours or more. Our PEO partners handle postings, break policies, and handbooks.
Recruitment and Onboarding Support
Tennessee's E-Verify rule counts employees under the same federal employer ID, including those outside the state, so a multi-state company can cross 35 sooner than it expects. PEO partners manage E-Verify, background screening, I-9 compliance, and onboarding.
Workers' Compensation and Safety Programs
Tennessee requires workers' comp at five employees for most businesses, and from the first employee in construction and coal mining. Construction is where Tennessee's rules bite earliest. PEOs provide coverage, safety programs, claims management, and return-to-work support.

Tennessee Is Several Markets, Not One
Nashville is a national hub for healthcare management and the music business, with a growing tech presence. Memphis runs on logistics, freight, and distribution. Knoxville and Oak Ridge bring energy research and advanced manufacturing, and Chattanooga mixes manufacturing, logistics, and a strong outdoor tourism economy.
A healthcare billing company in Brentwood and a third-party logistics firm in Memphis need very different things from a PEO.
So our first conversation is about you: your headcount by state, your comp classes, and the kind of benefits that will help you hire.
